<h3>  A Safety Alert has been issued by the Department for Health aimed at organisations and individuals, who provide facilities for vulnerable people who are at risk of falling from windows.</h3>

<p>The alert follows an HSE investigation into a fatal incident where window side-stays, which were fitted with plastic spacers as part of the mechanism, failed.</p>
<p><strong>Any organisation where window restrictors are fitted to limit window openings (usually to not more than 100mm) in order to protect vulnerable people from falling, should be aware of this problem. Such organisations include NHS Trusts, care home providers and those who manage buildings where vulnerable people may be present (e.g. schools).</strong></p>

<p>According to the Alert, certain types of side-stay window restrictors incorporate a plastic spacer which, if allowed to deteriorate and crack may result in separation of the retaining rivet and failure of the restrictor.</p>
<p>Even with a restrictor fitted to each side of the window, the failure of one restrictor may be enough to allow egress with high risk of injury or death.</p>
<p><strong>Windows fitted with this type of side-stay restrictor should be examined and where necessary remedial repairs and control measures implemented.</strong><strong></strong></p>

<h3> Two men have been jailed for a total of 18 months for fraudulently taking health and safety tests on behalf of other construction workers.</h3>

<p>They both pleaded guilty at Luton Crown Court earlier this month, and were each given nine month jail terms.  CITB-ConstructionSkills say that this should act as a strong warning to other would-be fraudsters.</p>
<p>The cheating took place at CITB-ConstructionSkills’ test centre in Luton, Bedfordshire.  Their  Product Delivery Manager Chris Little, explained that staff uncovered the fraud, known as proxy testing, after realising the men had taken multiple tests using several other workers’ identification passes which bore their own photographs.</p>
<p>Mr Little commented:</p>
<p><em>“Both men were being paid to take the test by other candidates, and it soon became clear to us that the same men were taking the test for other people each time.”</em></p>
<p>CITB-ConstructionSkills Chief Executive Mark Farrar condemned the practice saying:</p>
<p><em>“I’m glad the vigilance of CITB-ConstructionSkills staff caught and put a stop to this illegal activity. We support the industry by continually investigating test fraud, and we take it very seriously indeed.</em></p>
<p><em>“Proxy testing is self-defeating because it both endangers the lives of the people who solicit it and their colleagues on construction sites. Those who are found to be proxy testing will be reported to the police and could face prosecution.”</em></p>
<p>Both men are foreign nationals and will be deported once they have served their sentences.  Over 500,000 people sit the test every year as a means of achieving a Construction Skills Certification Scheme (CSCS) card or a plant operators card.</p>

			<content:encoded><![CDATA[<p>Computer manufacturer Lenovo has recalled nearly 200,000 computers after a fire risk in the power source was identified.</p>
<p>The M70Z and M90Z all-in-one ThinkCentre PC’s sold between May 2010 and March 2012 were voluntarily recalled by Lenovo following reports of two incidents involving the computer.</p>
<p>One of the incidents resulted in a fire, while the other was only a smoke incident.</p>
<p>A recall was already made for 160,000 computers in March, but this has been expanded to 188,000.</p>
<p>In a statement on their website, the manufacturer said ‘Lenovo has determined that due to a failure of the power supply in the affected all-in-one PCs, the system can overheat and pose a fire hazard. Lenovo has received two customer reports of fire that resulted in damage to the PC.</p>
<p>‘Lenovo recommends that you should immediately stop using the affected desktop PC, and unplug the power cord. Only certain of the ThinkCentre M90z and M70z PCs sold in this timeframe are affected, and all of the affected systems can be identified by machine type and serial number.</p>
<p>‘Effective immediately, Lenovo is offering free power-supply replacements for all affected ThinkCentre M90z and ThinkCentre M70z all-in-one desktop PCs.’</p>

			<content:encoded><![CDATA[<p>Lottery funding has been granted to a Plymouth group for adults with learning disabilities making a new film about fire safety.</p>
<p>Plymouth People First has been given £9,100 by the Lottery-funded Awards for All scheme, and will produce a new film with support from Devon and Somerset Fire and Rescue Service.</p>
<p>The film will be aimed at vulnerable people in the communities and promoted by fire services nationwide.</p>
<p>The group – which is part of Plymouth’s Highbury Trust – plan to launch the film in June during Learning Disability Week.</p>
<p>Jill Singh, projects officer for self-advocacy for Highbury Trust said, &#8220;We worked closely with Devon and Somerset Fire and Rescue Service during 2011 and realised the need for an accessible film to reaffirm the important messages of fire prevention and safety.</p>
<p>&#8220;The DVD, planned by and starring adults with a learning disability, will provide advice for all vulnerable community members when it is launched in Plymouth and then promoted through the fire service nationwide.&#8221;</p>

<h3>A move to ensure new European Union policies or regulations are backed by solid evidence was announced on March 6 2012.</h3>

<p>Addressing delegates at the IOSH (Institution of Occupational Safety and Health) 2012 Conference and Exhibition, in Manchester, Professor Ragnar Löfstedt announced a new cross-party parliamentary committee of MEPs to promote evidence-based policy making in the EU.</p>
<p>The informal committee, to be launched at the European Parliament, in Brussels, in June, was one of a number of recommendations made by Prof Löfstedt in his UK Government-commissioned review of health and safety regulations last year.</p>
<p>He said:</p>
<p><em>“We feel it’s very important to promote evidence-based policy making in Europe. At the present time, we feel that the European Parliament is not always evidence-based in its policy making. With this committee, we have a welcome opportunity to look at this more closely.”</em></p>
<p>IOSH Chief Executive Rob Strange OBE said:</p>
<p><em>“We have always welcomed evidence-based policy-making and would welcome this committee and its vision of increasing the use of science to support health and safety regulations.</em></p>
<p><em>“We want to see that regulations are only introduced when they are based on good research and a genuine need.”</em></p>
<p>The committee will look at all directives and amendments which are aimed at protecting people from harm, including health and safety.</p>
<p>In November last year Professor Ragnar E Löfstedt published his landmark government-backed report “Reclaiming health and safety for all: An independent review of health and safety legislation”.</p>
<p>As a result, the government aims to reduce the number of health and safety regulations by a third, rising to over a half over the next 3 years, through combining, simplifying and reducing the approximately 200 existing regulations.</p>

<h3>The Health and Safety Executive (HSE) has announced that its cost recovery scheme, Fee for Intervention, will not be starting on the planned date of April 6 2012.</h3>
</div>
<div>
<p>Gordon MacDonald, HSE&#8217;s programme director, explained that <strong>the scheme will still go ahead but faces a delay of several months</strong>:</p>
<p><em>&#8220;The Government has agreed that it is right that those who break the law should pay their fair share of the costs to put things right &#8211; and not the public purse.</em></p>
<p><em>&#8220;The Government intends to proceed with the FFI scheme as recommended to ministers by HSE&#8217;s Board in December in response to the formal consultation that took place last Summer.</em></p>
<p><em>&#8220;Discussions are still taking place on the technical details of the scheme, which we expect to conclude soon.</em></p>
<p><em>&#8220;Therefore, FFI will not be introduced in April but at the next available opportunity, which is likely to be October 2012.&#8221;</em></p>
<p>The scheme sets out to recover costs from those who break health and safety laws for the time and effort HSE spends on investigating or taking enforcement action.</p>
<p>The HSE say that they intend to take advantage of the extra time to work further with businesses to improve their understanding of the scheme and how it will affect them.</p>
<p>Detailed guidance for employers and organisations will be available on HSE&#8217;s website ahead of implementation.</p>
<p>A practice run of the new processes and procedures underpinning the scheme is already underway in HSE and will continue until the scheme is implemented.</p>

<p>Lack of Commitment to Fire Safety cost another company and owner dearly. These fines could of been saved with effective risk assessment and fire safety training.</p>
<p>A London hotel has had to pay more than £260,000 in fines and costs in what is believed to be the first jury trial of a case under the Regulatory Reform (Fire Safety) Order 2005.</p>
<p>The hotel and director concerned had pleaded not guilty to a total of 12 offences under the Fire Safety Order. The trial took place at Blackfriars Crown Court between 28 November and 6 December 2011 and sentencing was on Monday 6 February.</p>
<p>The offences date back to 18 May 2008 when London Fire Brigade was called to a fire at the hotel in Finchley, north London. The blaze had spread quickly from a first floor guest bedroom, up a staircase to the floor above and along a corridor.</p>
<p>Luckily three people escaped from the fire, two by using the stairs and a third by climbing out of a second floor window.</p>
<p>Upon inspection following the blaze, fire safety inspectors visited the hotel and raised a number of concerns. These included defective fire doors, blocked escape routes and no smoke alarms in some of the hotel’s bedrooms. The owner was also unable to produce a suitable and sufficient fire risk assessment and was found not to have provided staff with adequate fire safety training.</p>
<p>The fine was divided between the individual defendant, the company director (£180,000) and the corporate defendant, the limited company (£30,000). The defendants were further ordered to pay prosecution costs of £50,000, and compensation of £2,000 to the guest who escaped through a second floor window.</p>
<p>The company was found guilty of six offences, while the director was found guilty of ‘consent or connivance in the commission’ of those same offences:</p>
<ul>
<li>Failure to make a suitable and sufficient assessment of risk (article 9)</li>
<li>Failure to provide staff with adequate safety training (article 21)</li>
<li>Failure to ensure emergency routes from the premises are kept clear (article 14)</li>
<li>Failure to adequately equip premises with fire detectors (article 13)</li>
<li>Two counts of failure to ensure premises, facilities, equipment or devices are maintained in an efficient state, in working order and in good repair (article 17)</li>
</ul>
<p>“Business owners have a clear responsibility under fire safety law to ensure that both the public and their employees are as safe as possible from the risk of fire,” said Brian Coleman, chairman of London Fire and Emergency Planning Authority. “This verdict sends out a clear message that if these responsibilities are ignored we will not hesitate in prosecuting and people will face serious penalties&#8221;</p>
